Please read these Terms of Service ("Terms") carefully before using the Rise & Reflect mobile application ("Service") operated by Matan Cohen Abravanel ("us," "we," or "our").

1. Acceptance of Terms

By accessing or using Rise & Reflect, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Rise & Reflect is an AI-powered voice journaling and personal reflection app designed to help you track goals, recognize patterns, and maintain a record of your personal insights. The Service is positioned as a "guide that helps you guide yourself" and is not intended to provide medical advice, therapy, or mental health treatment.

3. Age Requirement

You must be at least 13 years old to use Rise & Reflect. By using the Service, you represent and warrant that you meet this age requirement.

4. User Account

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating your account
• You must notify us immediately of any unauthorized use of your account

5. Subscription and Payments

Rise & Reflect operates on a subscription model:

• Subscription fees are charged through the Apple App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Refunds are subject to Apple's App Store refund policy
• We reserve the right to modify subscription pricing with notice to existing subscribers

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to harm, threaten, or harass others
• Reverse engineer, decompile, or disassemble any part of the Service

7. Medical Disclaimer

Important: Rise & Reflect is NOT a substitute for professional medical advice, diagnosis, or treatment. The Service is designed for personal reflection and self-discovery only. If you are experiencing a medical or mental health emergency, please contact emergency services or a qualified healthcare provider immediately.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Matan Cohen Abravanel and are protected by international copyright, trademark, and other intellectual property laws.

Your reflection content and insights remain your intellectual property. By using the Service, you grant us a limited license to process this content solely to provide the AI-powered features of the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

10. Limitation of Liability

To the maximum extent permitted by law, Matan Cohen Abravanel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted to or through the Service

11. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, or in the state or federal courts located in New York, NY.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
